Please read the following carefully to learn more about this Privacy Policy. This tells you what information we collect from you, the steps we take to protect and secure it, how we use and share information.
By accessing or using MomsGenie Platform/MomsGenie Platform Services in any manner whatsoever, you acknowledge that you understand and accept the terms and conditions, as well as the practices and policies outlined in this Privacy Policy; and you agree that MomsGenie Platform may store and use Your Information and the data relating to you in the manner, to the extent, and for the purposes, as outlined in this Privacy Policy.
We are endeavouring to ensure that our business practices that involve the use of your Personal Information are compliant with privacy regulations in the jurisdictions where we operate. Accordingly, in this Privacy Policy, we want not only to advise you of your privacy rights but also explain how we intend to respect them.
1. Definitions
1.1. Unless the context otherwise requires, the words and expressions defined in the MomsGenie Terms of Use have the same meaning wherever they appear in this Privacy Policy.
2. Scope Of This Privacy Policy
2.1. This Privacy Policy covers how we treat the Personal Information that we gather while you are accessing MomsGenie Platform or using any of MomsGenie Platform’s Services or content on MomsGenie Platform.
2.2. This Privacy Policy does not apply to the policies and practices of those entities that we do not own or control, or to the individuals whom we do not employ or manage.
3. Personal Information
3.1. Personal information about you may include your name, physical address, e-mail address, phone number, date of birth, details of transactions made by you, information about the pages accessed or visited by you, information volunteered by you, such as survey information, and/or information entered by you while making any transaction on or through MomsGenie Platform, and any other information you may wish to provide (collectively, “Personal Information”) that can be used to personally identify you.
4. Non-Personal Information
4.1. We also collect “non-personal” information from you, such as your browser type, the URL of the previous website you visited, your ISP, operating system, and your IP Address (collectively, “Non-Personal Information”), which cannot be easily used to personally identify you.
5. Types Of Information Collected By Us
5.1. Personal Information provided by Users
(a) We receive and store all and any Personal Information you enter on MomsGenie Platform while registering yourself for setting up your account, making a purchase or any other transaction, or using MomsGenie Platform in any manner whatsoever on or through MomsGenie Platform and/or any other information/data which you provide to us in any other way, whereas such information may include, without limitation, your name, date of birth, e-mail address, physical address, phone number, etc.
(b) Personal Information is used for such purposes as
(i) Identification and authentication, contact and support;
(ii) Responding to your requests for accessing certain information and/or using any of MomsGenie Platform Services;
(iii) Customizing the advertising and content you see on MomsGenie Platform;
(iv) Communicating with you about MomsGenie Platform Services and promotional offers; and/or
(v) Research and improvement of MomsGenie Platform Services.
(c) Your e-mail address may be used by us to send you updates, newsletter(s), and/or news regarding MomsGenie Platform/MomsGenie Platform Services.
(d) We also record the details of transactions made by you on MomsGenie Platform.
5.2. Non-Personal Information Collected Automatically
(a) We automatically receive and record Non-Personal Information on our server logs from your browser including your IP address, cookies, and the pages you request.
(b) Generally, MomsGenie Platform automatically collects usage information, such as the numbers and frequency of visitors, similar to TV ratings that indicate how many people watched a particular show. We use this data in aggregate form only; i.e., as a statistical measure, and not in a manner that would identify you personally. This type of aggregate data enables us to figure out how often users use parts of MomsGenie Platform/MomsGenie Platform Services so that we can make them useful to as many users as possible, and improve those Services and features.
(c) As part of this use of Non-Personal Information, we may provide aggregate Non-Personal Information to our affiliates, partners, and/or advertisers about how our users, collectively, use MomsGenie Platform. We share this type of statistical data so that our affiliates, partners, and advertisers also understand how often the users use their services and websites, so that they, too, may provide you with an optimal online experience.
(d) However, we never disclose aggregate Non-Personal Information to an affiliate, a partner, or an advertiser in a manner that would identify you personally.
(e) We may receive a confirmation when you open an e-mail from us if your computer supports this type of program. We use this confirmation to help us make e-mails more interesting and helpful.
5.3. Personal Information tracked through cookies:
(a) A cookie is a small amount of data, which often includes an anonymous unique identifier that is sent to your browser from a website’s servers and stored on your computer’s hard drive. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set.
(b) We use our own cookies for a number of purposes, such as:
(i) To keep track of preferences you specify while you are using MomsGenie Platform Services.
(ii) To estimate and report our total audience size and traffic.
(iii) To conduct research to improve the content of MomsGenie Platform and MomsGenie Platform Services.
(c) We use session cookies to allow you to carry information across pages of MomsGenie Platform and avoid having to re-enter information.
(d) We use persistent cookies for the following purposes:
(i) To help us recognize you as a unique visitor when you return to MomsGenie Platform, or to allow us to tailor content or advertisements on MomsGenie Platform to match your preferred interests, or to avoid showing you the same advertisements repeatedly.
(ii) To compile anonymous, aggregated statistics that allow us to understand how people use MomsGenie Platform, and to help us improve the structure of MomsGenie Platform.
(iii) To internally identify you by your actual name, e-mail address, currency, and location (geographic and computer ID/IP address).
(e) Third-party cookies are used via MomsGenie Platform for the following purposes:
(i) To serve advertisements on MomsGenie Platform and track whether these advertisements are clicked on by users.
(ii) To control how often you are shown a particular advertisement.
(iii) To tailor MomsGenie Platform content to your preferences.
(iv) To count the number of anonymous users of MomsGenie Platform.
(v) For MomsGenie Platform usage analysis.
(vi) Advertisements appearing on MomsGenie Platform may be delivered to users by advertisers, who may set cookies that allow their servers to recognize your computer each time they send you an online advertisement, and to compile information about you or others who use your computer, which allows their networks to deliver targeted advertisements that they believe will be of most interest to you.
(f) This Privacy Policy covers the use of cookies by us, but it does not cover the use of cookies by the advertisers.
6. Types Of Information Collected By Us
6.1. We know that you care about how your Personal Information is used and shared, and take your privacy seriously. We are not in the business of selling information about you; we use the information shared with us for the sole purpose of running and improving MomsGenie Platform Services, strictly in accordance with this Privacy Policy.
6.2. All information gathered by us is for the express purpose of enabling a more productive, customized, and efficient experience for our users.
7. How Your Information Is Used
7.1. The primary purpose for which we collect Your Information is to provide you, the user, with a safe, smooth, efficient, and customized experience. You hereby agree that we may use Your Information to –
(a) Allow you access and make use of, and participate in MomsGenie Platform Services and deals offered on MomsGenie Platform.
(b) Maintain our records.
(c) Monitor MomsGenie Platform usage levels and quality of MomsGenie Platform Services.
(d) Customize, measure, and improve the content and advertising on MomsGenie Platform.
(e) Provide the needed customer support on the user’s request.
(f) Resolve disputes, and troubleshoot problems.
(g) Prevent potentially prohibited or illegal activities, and enforce the provisions of MomsGenie’s Terms of Use as well as MomsGenie’s Policies and all the documents they incorporate by reference.
(h) Notify users about MomsGenie Platform Services and their updates, besides targeted marketing and promotional offers based on their individual preferences.
(i) Compare information for accuracy, and verify it with Third-parties.
(j) Provide information required by Third-party service and sales providers, who are prohibited from using that information for any other purpose than to deliver their goods and services.
7.2. If you do not wish to receive alerts and marketing, promotional or sales material from us, you may notify us via email at support@momsgenie.com that no further material be sent to you. We will, as soon as reasonably practicable after receiving your request, remove your contact details from our marketing database.
7.3. All rights in the manner of recording Your Information held by us (including copyright and database rights) are and shall remain our property.
8. To Whom/Where Your Information May Be Disclosed
8.1. Your Information is an integral part of our business. We neither rent nor sell Your Information to anyone.
8.2. By accessing and/or using MomsGenie Platform; you hereby consent to our sharing/display of Your Information for the purposes, to the extent, and in the manner, as mentioned below:
(a) Sharing with affiliated business entities we do not control. We anticipate that we may become affiliated with a variety of business entities, and work closely with them. In certain situations, these businesses may offer services or products to you on or through MomsGenie Platform. In other situations, we may provide you Services or Products jointly with affiliated business entities.
(b) Sharing with agents, partners and/or associates. We employ several entities as our agents, partners and/or associates to perform tasks on our behalf, and we need to share Your Information with them in order to provide MomsGenie Platform Services to you. The examples of such tasks include, without limitation, delivering the Products/Services ordered by you, sending e-mail to you, analyzing data, etc. Unless we tell you differently, our agents, partners and/or associates do not have any right to use Your Information we share with them beyond what is necessary to assist us.
(c) Sharing with advertisers. You acknowledge and agree that we, in our sole and absolute discretion, and without any notice to you, are at liberty to share with the advertisers, any and all information we gather and/or collect about you in any of the manners/modes specified herein or otherwise, for being used by them in any such manner as deemed suitable and appropriate by them.
(d) Transmission on account of business transfer/acquisition. As we continue to develop our business, we may also buy or sell all the whole or part of our business. In such transactions, the information you have shared with us is generally one of the business assets that will be transferred. Moreover, if our business, or substantially all of our assets, were transferred to or acquired by a Third-party, or in the unlikely event that we go out of business or enter bankruptcy, your Personal Information would also be transmitted to, or acquired by, such Third-party or bankruptcy administrator, as the case may be. You acknowledge that such transfers/acquisitions may occur, and that any acquirer of our business may continue to use your Personal Information subject to the terms and conditions set forth in this Privacy Policy, or its subsequent versions, to which you have consented.
(e) Release/Disclosure for protection of us, our constituents and others. We may -
(i) release Your Information when we believe in good faith that such release is necessary to comply with the provisions of law; or to enforce or apply the MomsGenie’s Terms of Use, MomsGenie’s Policies and all the documents they incorporate by reference; or to protect rights and/or property of our constituents, agents, partners. associates and/or the advertisers. This includes, without limitation, exchanging information with other companies and organizations for protection against fraud;
(ii) share Your Information to respond to court orders or legal process, to establish or exercise our legal rights, or to defend against legal claims and, if in our sole judgment, disclosure is required or is appropriate in such circumstances;
(iii) share Your Information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the MomsGenie’s Terms of Use, MomsGenie’s Policies and all the documents they incorporate by reference, or as otherwise required by law;
(iv) where required by law, and in circumstances where we deem it appropriate, disclose Your Information to an applicable governmental, regulatory, or enforcement authority;
(v) if you are a winner of contests, giveaways and other promotions, give Your Information to a Third-party for the verification of eligibility and the delivery of prizes; and
(f) Consensual Sharing. Save as the circumstances and conditions set forth hereinabove, you will be notified when Your Information may be shared with Third-parties, and will be given the option to prevent such sharing.
9. Confidentiality & Security Of Personal Information
9.1. We use physical, electronic, and procedural safeguards to protect your Personal Information entered on or through MomsGenie Platform.
9.2. In certain areas, we use industry-standard encryption techniques to protect data transmissions. However, please note that this is not a guarantee that Your Information may not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software.
9.3. We endeavour to protect your Personal Information to ensure that it is kept private; however, we cannot guarantee the security of such information because no data transmissions over the internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any Personal Information you transmit to us; as such, you do so at your own risk.
9.4. We do not store any of your credit/debit card, net banking or payment wallet details/data on MomsGenie Platform. All such details/data are used by Third-party payment gateways such as RazorPay and PayU only for the purpose of completing the transaction of payment made by you for the order(s) placed on MomsGenie Platform, and the entire responsibility to protect the confidentiality/secrecy of those details/data and to prevent any misuse thereof solely rests with the concerned payment gateway. We disclaim any responsibility to prevent the misuse – fraudulent or otherwise – of your these details/data in any manner whatsoever.
9.5. Once we receive your information, we make efforts to ensure security on our systems. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of Users’ Personal Information at any time.
9.6. MomsGenie Platform contains links to other Third-party websites (“Linked Sites”). We are not responsible for the privacy policies and/or practices being followed on the Linked Sites. When linking to or visiting any of the Linked Sites, it is advised that a User should read the privacy policy stated on that Linked Site.
10. CHANGES TO PRIVACY POLICY
10.1. We may make changes to this Privacy Policy from time to time for any reason. Use of Your Information we collect is subject to the Privacy Policy in effect at the time such information is used.
10.2. We reserve the right to make changes in the way we use Your Information, at any time and without any notice, by posting our amended Privacy Policy on MomsGenie Platform. You are responsible for reviewing the changes, if any, and complying with them regularly.
10.3. Each version of this Privacy Policy, posted on MomsGenie Platform, will show the effective date of amendment; i.e., the date with effect from which this Privacy Policy is amended. By your continued access or use of MomsGenie Platform/MomsGenie Platform Services, you acknowledge and accept the validity and applicability of amended Privacy Policy.
11. Effective Date
11.1. This Privacy Policy is effective as of October 3, 2024.
